KES MAHKAMAH MB PERAK : PANDANGAN PENSYARAH UNDANG-UNDANG DR SHAMRAHAYU A. AZIZ DAN DR ABD RANI KAMARUDDIN !


Di bawah ini disiarkan pandangan dan komen dua orang pensyarah dari UiTM Dr Shamrahayu A. Aziz dan Dr Abd Rani Kamaruddin UIAM yang telah mengahantar komen berkaitan keputusan Mahkamah hari ini mengetahui status kes mahkamah MB Perak. Komen ini dihantar ke blog PG di KLIK

Salam . Sekadar untuk berkongsi setelah menerima keputusan sebulat suara panel 5 orang Hakim Mahkamah Persekutuan lewat pagi tadi. Saya lampirkan pendapat saya yang telah dipetik oleh Bernama pada 6 Feb 2008. Pendapat saya ini telah disanggah oleh Prof Abdul Aziz Bari,(pembaca boleh layari Malaysians Unplugged atau Malaysiakini)

Circumstances May Imply No-Confidence - Expert

KUALA LUMPUR, Feb 6 (Bernama) -- Although former Perak menteri besar Datuk Seri Mohammad Nizar Jamaluddin believes that a vote of no-confidence is needed for his removal, circumstances may prove otherwise.Constitutional law expert Associate Prof Dr Shamrahayu Abdul Aziz said a motion of no-confidence could be established through a vote of no-confidence at the state legislative assembly or arise from "extraneous circumstances" that may imply that the elected representatives no longer had the confidence in the menteri besar.

She said the statement by Sultan Azlan Shah yesterday, as well as the three defections from Pakatan Rakyat who later declared their support for Barisan Nasional (BN), were indication enough of a no-confidence vote against the menteri besar."Mohammad Nizar is arguing that there was no formal voting passed by the state assembly on the motion of no-confidence against him, but I beg to differ.

"Motion of no-confidence can also arise due to circumstances," she said when contacted by Bernama on Friday.She cited the case of Datuk Amir Kahar Mustapha vs Tun Mohd Said Keruak in 1994, which involved former Sabah chief minister Datuk Joseph Pairin Kitingan when there were several defections from the party after the 1994 general election.Shamrahayu said the court ruled that the circumstances showed there was no more confidence in Pairin Kitingan, leading the latter to tender his resignation."

I think this should be the argument on behalf of the Sultan, (that he had came to the conclusion) after meeting members of the Perak BN and the three defectors who expressed support for BN."Although we do not know what had transpired exactly, I believe the decision made was in the Sultan's wisdom," she said.Asked if the contents of the meeting should have been made public, Shamrahayu said it was not necessary."Although in a democratic government, that would be favourable, I don't think it's a legal requirement to make it transparent to the public," she said.She said the Sultan had clearly explained his decision through the statement released by his office yesterday, and the public should understand and accept his decision.

"I think the letter is sufficient, there is no need for the Sultan to stand up in front of the people and explain what he meant," she said.Mohammad Nizar has insisted that the Pakatan Rakyat government is legitimate and would not tender his resignation until there was a vote of no-confidence against him.Pakatan Rakyat is also intending to take legal action against the Sultan for appointing a new BN menteri besar at Istana Iskandariah in Kuala Kangsar.-- BERNAMA

Salam pembaca,seorang anak (A) mengadap ayahnya dan memohon supaya kereta pemberian ayahnya itu dilupuskan, namun ayahnya tidak memperkenankan permohonannya. Ayahnya kemudian melantik anaknya (B) yang lain mengambil alih kereta itu, tiba-tiba A tidak dapat terima kenapa B diberikan kereta itu. Dia (A) sudah tidak mahu kereta itu tapi bila B dapat, dia nak balik kereta itu.

Penghuni Gua : Akhirnya pendapat 2 orang pensyarah dan pakar undang-undang dari universiti tempatan ini juga yang betul dan sama dengan panel 5 YAA Hakim ini dalam kes ini.

2. Sebabnya satu sahaja. Mereka memberi hujah secara akedemik dan berfakta serta di atas platform bebas.

3. Tahniah Dr Abd Rani Kamaruddin UIAM yang sepanjang masa menghantar komen ke bloh PG sejak krisi ini bermula dan begitu juga Dr Shamrahayu UiTM. Tahniah atas pendapat dan pandangan bernas dr berdua dan PG harap Dr berdua dapat meneruskan usaha murni ini agar warga Malaysia akan lebih berpengetahuan dalam perkara yang berkaitan dengan perlembagaan dan undang-undang .

4. Pandangan Dr berdua , PG rasakan telah membuka begitu luas minda PG dan rakan-rakan dalam memahami apa yang berlaku dalam politik Malaysia serta perkara-perkara yanbg berkaitan perlembagaan.

5. Tidak ketingglan juga kepada Dr Siddiq Azani UIAM yang juga kerap menyiarkan pandangan dan pendapatnya mengikut undang-undang dan pelembagaan negara yang mana ia amat bermenafaat kepada PG dan rakan pembaca yang lain.

6. Semuga Malaysia terus aman damai. Amin.

  2. Kisah kat perak ni samalah dengan satu drama cina kat tv x lama dulu yang pernah aku tonton. Ia berkisar kepada perangai manusia iaitu semasa ada kuasa x pernah nak jaga dan bila terlepas kepada orang baru lah nak menyibuk. Ini yang terjadi kepada si nizar ni. Masa dapat kuasa x tau nak perintah dok sibuk dengan DAP/PKR last-last semua terlepas dan terlopong. Bengong......bengong....kah...kah...he..he..he
